Preparation and participation in the fourth, fifth, sixth, seventh, eighth and ninth Negotiating Committee meetings

The project team assisted in the preparations for the Negotiating Committee meetings (NCMs) that took place since 2016. The project supported the participation of Caribbean CSO representatives, thus ensuring the involvement of key stakeholders in the negotiation process. The delegates were selected in consultation with the LAC P10 public representatives and the UN ECLAC Secretariat for the P10 process.

  • The fourth meeting took place on August 9–12, 2016, in the Dominican Republic.
  • The fifth meeting was held on November 21–25, 2016 in Santiago, Chile.
  • The sixth meeting was held on March 20-24, 2017 in Brasilia, Brazil.
  • The seventh meeting took place between July 31 and August 4, 2017, in Buenos Aires, Argentina.
  • The eighth meeting took place between November 27 and December 1, 2017, in Santiago, Chile.
  • The ninth and final meeting took place in San José, Costa Rica, February 28-March 4, 2018.

On 4 March 2018, the Negotiating Committee, adopted the final text of the Escazú Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters. The first legally binding regional agreement in the Latin American and Caribbean region was adopted by the delegates of 24 LAC governments in the presence of the representatives of the public and international organizations, in a ceremonial event attended by among others the President of Costa Rica, the Secretary of ECLAC, and several ministers and vice-ministers of the LAC region. The agreement will be open for signature in New York, from September 24, 2018 for one year and will enter into force upon ratification by 11 Parties. Side event on “Facilitation and Follow-up Committee

Side event on was organized on August 1, 2017 on “Facilitation and Follow-up Committee”, jointly by Costa Rica, DAR, FARN, FIMA, Human Rights Watch and REC, and co-sponsored by the project, Building Bridges, during the 7th Negotiating Committee Meeting held in Buenos Aires, Argentina, July 31-August 4, 2017.

Article 17.4 of the draft text of the Agreement plans to establish a Facilitation and Follow-up Committee as a subsidiary body of the Conference of the Parties to promote application and support the Parties with implementation of the Agreement. This type of mechanism, generally known as a compliance mechanism, has been included in multilateral environmental agreements as one of the tools available to the Parties to strengthen implementation and compliance. The side event with the participation of Mrs. Patricia Madrigal, Moderator, Vice Minister, Ministry of Environment and Energy, Costa Rica, John Knox, UN Special Rapporteur on Human Rights and the Environment, Mr. Jerzy Jendrośka, Member of the Aarhus Convention Compliance Committee and Arbitrator at the Permanent Court of Arbitration in The Hague and Mr. Marcos A Orellana, Director, Environment and Human Rights Division, Human Rights Watch, discussed the following issues:

  • The role fulfilled by compliance committees in the implementation of international agreements;
  • The differences between non-adversarial, non-judicial and consultative compliance committees and other mechanisms for implementation or settlement of disputes;
  • The importance of participatory and transparent modalities and procedures in the functioning of the compliance committee.

Webinar on Public Participation

On October 14, 2016, the REC organised a webinar on Article 8 of the Regional Agreement on Access to Information, Participation and Justice in Environmental Matters in Latin America and the Caribbean.

The objective of the webinar was to discuss proposals from the public on Article 8 of the Regional Agreement in order to finalise a proposal for presentation by the public as a revised draft at the Negotiation Meeting in Chile on November 21–25, 2016.
